Welcome to LactCheck. By accessing or using lactcheck.benevolencelabs.com (“LactCheck” or the “Service”), operated by Benevolence Labs (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

1. Service Description

LactCheck provides estimated medication safety information for breastfeeding mothers. The Service includes:

• Estimated Milk-to-Plasma (M:P) ratios for medications
• Estimated Relative Infant Dose (RID) percentages
• Drug class safety rankings and comparisons
• Information sourced from published peer-reviewed studies and clinical databases
• Machine learning predictions for medications not yet in our database

3. Information Accuracy and ML Predictions

We work to ensure information accuracy, but cannot guarantee completeness, accuracy, or currency of all data. Information on LactCheck comes from:

• Published peer-reviewed clinical studies
• Established clinical databases (including LactMed)
• Machine learning predictions generated using computational modeling

Machine learning predictions carry inherent uncertainty. ML predictions are estimates based on molecular structure similarity and should be treated as such — not as verified clinical measurements. Predictions are flagged when molecular structure is unusual or when the drug has limited training data. Always verify predictions with a healthcare provider.

4. Third-Party Services

LactCheck relies on third-party services for core functionality:

• Stripe — Payment processing and subscription management. Stripe’s terms of service apply to payment transactions.
• PubChem — National Institutes of Health database used to retrieve molecular structure data for ML predictions.
• Our ML API — Drug names are sent to our ML API to generate safety predictions.
• Supabase — Authentication and database services.

We are not responsible for the privacy practices, terms, or availability of these third-party services. Review their respective terms and privacy policies.

5. User Eligibility and Responsibilities

You must be at least 18 years old to use LactCheck. By using the Service, you represent that you are at least 18 and responsible for all activity under your account.

By using LactCheck, you agree to:

• Provide accurate information when creating and maintaining your account
• Verify all medication safety information with a qualified healthcare provider before acting on it
• Not use the Service for any unlawful purpose or in violation of these Terms
• Not attempt to reverse-engineer, copy, or extract data from the Service
• Not rely solely on this Service for medical decisions of any kind
• Keep your account credentials secure and notify us of any unauthorized access

6. Subscriptions and Payments

LactCheck offers a Free plan and a Pro plan. All paid subscriptions are processed by Stripe.

• Free Plan — Access to verified clinical data and limited ML predictions
• Pro Plan — Unlimited ML predictions, drug class rankings, and advanced features at $5.99/month or $59.99/year

Subscription Terms:

• Subscriptions are billed monthly or annually in advance, depending on your plan
• You may cancel your subscription at any time through your account settings
• Upon cancellation, you retain access to paid features until the end of your current billing period
• We reserve the right to change pricing with 30 days notice posted on the Service

7. Account Management

If you create a LactCheck account, you agree to:

• Keep your password confidential and secure
• Accept responsibility for all activities under your account
• Notify us immediately of any security breach or unauthorized use
• Accept that we may suspend or terminate accounts that violate these Terms

You may delete your account and request data deletion at any time by contacting [email protected].

8. Intellectual Property

The LactCheck name, logo, design, and all content are property of Benevolence Labs.

We respect intellectual property rights and expect the same from users. If you believe content on LactCheck infringes your copyright, contact us at [email protected] with details.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LACTCHECK AND BENEVOLENCE LABS PROVIDE THE SERVICE “AS IS” AND “AS AVAILABLE.”We make no warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that ML predictions are accurate or complete.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENEVOLENCE LABS DISCLAIMS ALL LIABILITY for any direct, indirect, incidental, special, exemplary, or consequential damages arising from:

• Your use of, or inability to use, the Service
• Any decisions made or actions taken based on information from the Service
• Any errors, inaccuracies, or omissions in Service content
• Any unauthorized access to your account
• The conduct of any third party on or connected to the Service

Total liability under these Terms shall not exceed $100 USD or the amount you paid us in the 12 months preceding the claim, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless Benevolence Labs, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of your use of LactCheck or violation of these Terms.

12. Termination

Your access. You may stop using LactCheck at any time. You may also delete your account at any time through settings or by contacting support.

Our access. We reserve the right to suspend or terminate your access to LactCheck at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent or abusive activity, non-payment of subscription fees, or to protect the integrity and security of the Service. Where feasible, we will provide notice before termination.

Upon termination, your right to use the Service ceases immediately. Sections 2, 3, 9, 10, 11, 13, 14, and 16 survive termination.

13. Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by the LactCheck Privacy Policy. By using LactCheck, you agree to the collection and use of information as described in our Privacy Policy.

14. HIPAA and Health Information

LactCheck is not subject to HIPAA. The Health Insurance Portability and Accountability Act (HIPAA) applies only to “covered entities” (health plans, healthcare providers, and healthcare clearinghouses) and their “business associates.” LactCheck is a consumer-facing software tool and is not a healthcare provider, health plan, or clearinghouse. Accordingly, HIPAA’s privacy and security requirements do not apply to LactCheck.

Nonetheless, we take the sensitivity of health-related information seriously. We collect only the information necessary to provide the Service, as described in our Privacy Policy. We do not sell or share your health-related search information with advertisers or third parties.

15. Force Majeure

Benevolence Labs is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, strikes, power outages, changes in laws or regulations, or failure of third-party service providers.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles.

Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of LactCheck shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, either party may initiate binding arbitration under the rules of the American Arbitration Association, conducted in Texas. The arbitrator’s decision is final and binding, and judgment may be entered in any court of competent jurisdiction.

Class action waiver. You agree that any dispute resolution will be conducted on an individual basis only — not as a plaintiff or class member in any class, consolidated, or representative proceeding.

17. Electronic Communications

By creating an account or subscribing to LactCheck, you consent to receive electronic communications from us, including via email. These communications may include service announcements, billing notifications, and changes to the Service or these Terms. You may opt out of marketing emails at any time by clicking the unsubscribe link.

18. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will post the updated Terms on this page with a revised “Last updated” date, and — for significant changes — provide notice via email to your registered address.

Continued use of LactCheck after changes take effect constitutes acceptance of the new Terms. If you do not agree to updated Terms, you must stop using the Service and cancel your subscription.
